DISPUTE RESOLUTION

Informal Resolution

Before initiating arbitration, the parties agree to attempt to resolve disputes informally.

Binding Arbitration

Any dispute arising from or relating to the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules. Arbitration may be conducted in person, by telephone, by video conference, or through written submissions. Unless otherwise required by applicable law or agreed by the parties, the arbitration shall take place in the State of Texas. The parties consent to the personal jurisdiction of the courts located in Texas for purposes of enforcing arbitration awards.

The arbitrator must follow applicable law.

Arbitration Opt-Out

You may opt out of arbitration by sending written notice within thirty (30) days of first accepting these Legal Terms.

Small Claims Exception

Either party may bring an individual claim in small claims court if the claim qualifies.

Class Action Waiver

Disputes must be brought individually. Class actions, consolidated proceedings, or representative claims are not permitted.

DISCLAIMER OF WARRANTIES

THE SERVICES AND ALL CONTENT MADE AVAILABLE THROUGH THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • TITLE
  • NON-INFRINGEMENT

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
  • DEFECTS WILL BE CORRECTED
  • THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • INFORMATION PROVIDED THROUGH THE SERVICES IS COMPLETE, ACCURATE, OR CURRENT

THE SERVICES MAY CONTAIN INFORMATION ABOUT PRODUCTS OR SERVICES PROVIDED BY THIRD PARTIES. WE DO NOT ENDORSE OR GUARANTEE ANY THIRD-PARTY PRODUCTS OR SERVICES.

THE COMPANY ASSUMES NO RESPONSIBILITY FOR:

  • ERRORS OR INACCURACIES IN CONTENT OR MATERIALS
  • UNAUTHORIZED ACCESS TO OR USE OF COMPANY SYSTEMS OR SERVERS
  • INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES
  • VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS TRANSMITTED THROUGH THE SERVICES BY THIRD PARTIES

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

THIRD-PARTY SERVICES AND TRANSACTIONS

The Services may contain links to or references to products, services, or websites operated by third parties. Such third-party services are not owned or controlled by the Company.

The Company does not endorse, guarantee, or assume responsibility for any third-party products, services, or content made available through the Services.

FORCE MAJEURE

No joint venture, partnership, or employment relationship is created through use of the Services.
